        claims in federal  courts, where the  agency may face a higher burden 
        of proof.

    SCotUS had reviewed FTC's consumer protecting powers and unsurprisingly, ruled them out of existence. This allowed the 5th circuit to intervene and safeguard Intuit's profitable, deceptive practices.
